Abstract

The present work deals with the content of the judgment of the Direct Action of Unconstitutionality 1.33 5/BA, in the midst of which the Supreme Federal Court recognized the constitutionality of a State Decree that establishes measures to be taken by the Public Administration in case of a strike movement by part of the servers of that federative unit. Thus, we carried out an analysis of both the formal and the material validity of the Decree, concluding by its legality, in theory, but not without making some reservations regarding the imposed measures, especially those of a disciplinary nature.
