The limitations of artificial intelligence in the legislative lexicon: a proposal to rescue the science of legislation

The article demonstrates that, considering the urgent need for the regulation of artificial intelligence (AI) and the difficulty of doing so, it is necessary to highlight the importance of legislative science. The elaboration of legislative texts presupposes reconciling the worlds of current language and technical language. It also presupposes a kind of "inverted subsumption". The brute fact is taken and converted into a standard fact on the basis of its fixed and central elements. Given the unpredictability of AI, its structure, as a brute fact, is unstable, dynamic. Impossible to create a de facto model of AI. Therefore, it is not capable of being a normative object by itself. The regulation of AI that involves risk should be limited to the matter on which AI falls.
