Intellectual property in public procurement: between the protection of ownership by the contracting public authority and the promotion of innovation

The Brazilian national legislation on public procurement (Law 14,133/2021) deals with intellectual property in administrative contracts in articles 30, sole paragraph, and 93. The legislator sought to protect not only the contractor’s ownership of the result of the execution of the contract made at its expense when it is an object susceptible to intellectual property, but it also seeks not to inhibit private initiative in innovation. This text presents a comparative analysis of the rules in force with the provisions of the previous art. 111 of Law 8,666/1993, as well as examines its scope, technical suitability and incidence hypotheses.
