This article presents considerations about the decision given by the Supreme Court in RE 918,315/DF (DJe – March 17th, 2023), Theme 1,096. This appeal had as object the reform of a judgment filed by the Court of Justice of the Federal District and Territories, in which the constitutionality of a district law that conditioned the payment of disability retirement, resulting from mental illness, to the declaration of incapacity of the beneficiary, as well as to the appointment of a trustee who would be responsible for receiving the earnings, was recognized.
