Abstract

This current research aims the development of an analysis of the judgment of The Warrant no. 35.038/DF, when the Brazilian Supreme Federal Court analyzed the possibility of imposing precautionary measures by the Courts of Auditors to ensure the effectiveness of the sustitution decisions applied by the National Congress, according to constitutional norm. Although the transit in judgment has taken place after rejection of declaration embargoes, it is opted for the analysis of the merits of the case, for the importance of its content, to, in the end, conclude by the partial adjustment of the Supreme Court.
