Objective liability in the cases of State omission: comments on the judgment of the RE 598,356/SP

This article aims at analyzing the judgment of RE 598,356/SP, which, in a unanimous vote, condemned a company that provides public service to compensate for the damages caused by theft of a transportation company truck, which occurred at the time of inspection at a weighing station. The central topic of debate is the application of objective liability in cases of omissive conduct by the State.
