Legal Hermeneutics and Political Philosophy: interpretation of fundamental political issues

Crucial legal controversies, which are morally and politically charged, cannot be adequately resolved simply by interpreting constitutional and legal texts and precedents. They cannot be sufficiently based solely on contributions from the general theory of any law subject or dogmatics. These controversies can be satisfactorily resolved as long as they involve moral or political value judgments; judgments on fundamental political issues such as freedom, justice, inequality, property. The aim of this article is to demonstrate that the truly dramatic issues of Law, which are present and repeated in the most diverse political orders, require critical, rational and moral reflections, thinking and methodology that go beyond the pure interpretation of constitutional and legal statements, judicial precedents and even doctrine. The conclusion is that the construction of arguments, for the most appropriate solution of these cases, requires evaluative reasoning about the fundamental political issues that involve the dimensioning of the legal order, of the institutes and institutions of government.To prove my point, I use tax issues as examples.
