The current panorama of public service concessions

This paper aims to explore public service concessions from their historical context to their current role as a management technique for essential services provided by private entities. It initially presents the transition from a direct state administration model, with maximum responsibility, to a system focused on guarantee and regulation, in which the state retains a reduced responsibility. It also examines the impact of public service privatization and the "Americanization" of European administrative law, highlighting the influence of the U.S. public utilities model on network industries such as energy and telecommunications. The paper then discusses a potential "crisis" in concessions, related to the shift toward a minimal and liberalized state, resulting in a redefined concept of public service. Finally, it analyzes the concepts of public service and concession, particularly the latter as a tool for collaboration between public administration and the private sector, adapted to the new administrative and economic context.
