: In this study, Robert Alexy reconstructs the formal structure of balancing, which is the third sub-principle of proportionality, using the so-called 'weight formula.' The mathematical formula aims to describe the concrete weight of one principle in relation to another, considering factors such as the intensity of intervention and the importance of fulfilling conflicting principles. The jurist analyzes the criticisms formulated by Giovanni Battista Ratti and Manuel Atienza, but argues that balancing is a necessary form of argument in rational and legal discourse. This is an essentially doctrinal study within the fields of Legal Theory, Hermeneutics, and Constitutional Law.
