The Brazilian Supreme Court granted in part the ADI 1.923/DF, establishing an understanding of partial constitutionality of the law by recognizing the management contract as na agrément and not a public contract from the strict observance of the constitucional principles of publicity, morality, impersonality, efficiency and, therefore, the guarantee of public process for the qualification of entites as social organizations. Although, it is necessary to analyze the social organizations, the contexto of their creation and their legal nature, in order to identify the effects of the decisions and the consequences on the theme.
