The legality control of normative acts exercised by the federal court of accounts: Decision nº 2454/2025

This excerpt aims to reflect on the limits of the Federal Court of Accounts’ (TCU) authority, based on its constitutional and statutory powers regarding the exercise of legality control over infralegal normative acts. It does so through the analysis of Ruling No. 2454/2025 – Plenary Session, in which the TCU declared the unconstitutionality of CODEFAT/MTE Resolution No. 1.001/2024, which established a pilot program allowing civil society organizations to manage units of the National Employment System (SINE) using resources from the Workers’ Assistance Fund (FAT). The Court’s action is understood as a legitimate exercise of External Control, as it intervenes incidentally to ensure legality and uphold the primacy of the Legislative Branch over regulatory overreach by the Executive.
