Administrative law’s rupture: A study about its succession by compliance law

Administrative Law is supported by the State and is oriented by the public good. The collapse of these elements, nonetheless, incites the search for other legal branches able to face the challenges answered by the administrative subject. This study postulates, in a qualitative approach and employing a deductive methodology, the recourse of the Compliance law to ruling the public environment. The article is designed in three parts. First, it affirms the compliance law surpasses mere conformity to the laws and is oriented to the achievement of monumental goals unachieved by the State. Second, it could not ignores the adjudicatory and prescriptive abilities of enterprises: it possesses the same binding character as state rules. Finally, the study identifies un obstacle to the succession for compliance law in the administrative law affairs: the deference, following administrative law. It concludes that, even if one disagrees with the arguments presented, this study provides resources either to the reinvention or to the reform of administrative law.
