The juridical nature of the environmental administrative liability as to its understanding by Brazil ́s Superior Court of Justice

Abstract

This paper aims to study the juridical nature of the environmental administrative liability as to its understanding by Brazil´s Superior Court of Justice´s precedents. On the notice that the Court has overruled its preview understanding on the matter in order to align to the conception of the environmental administrative liability as of a subjective liability, this paper aims to study such overruling and the key precedents that established it, as such the reasons adopted by the Court on the matter.
