Human rights and new technologies: the contribution of the inter-american system

Abstract

In the face of a hyper-connected society driven by new technologies such as the internet, artificial intelligence, and neurotechnology, the article aims to assess the impact of new technologies on human rights and the impact of human rights on new technologies. It also discusses how the Inter-American system can contribute to the protection of human rights in this technological context, highlighting its principles of victim centrality, prevention, and precaution as central duties of the State, as well as the need for international cooperation among States. In this way, the article warns of the growing power of transnational technology corporations, whose global operations challenge traditional legal structures, presenting digital constitutionalism with the challenge of protecting rights and limiting these emerging powers.
