Essay on the Quantum State: postulates and fundamental principles

Abstract

The concept of the Quantum State proposes a new approach to state action in Administrative Law, emphasizing speed, convergence, and cooperation as fundamental principles. Inspired by quantum physics, this model suggests a state capable of dealing with the complexity and uncertainty of the contemporary world, surpassing the limitations of both the Social State and the neoliberal State. This article discusses the historical evolution of the state, the centrality of infrastructure, and the need for increasingly relational public contracts, based on Ian Macneil's Relational Contract Theory. Furthermore, it explores the constitutional foundations that legitimize this new state conception and its practical applications.
