Outsourcing by the government: comments on special appeal (RE) 760.931

Abstract

Recently, the Brazilian Supreme Court (STF) partly granted the Special Appeal RE 760.931 and affirmed the understanding brought by the Direct Action for Declaration of Constitutionality (ADC) 16 regarding the absence of secondary liability imposed on the Government when it outsources services, except where one demonstrates the Government’s fault in supervising the contract. The ruling calls for resuming the study on outsourcing by the Government. The present analysis examines not only the effects of the ruling by the Supreme Court, but also the developments the matter has experienced over the past two decades.
