Resumo

O estudo explora debates e experiências sobre o tema da democracia local, natureza e mudanças climáticas, propondo uma comparação a partir de críticas ecológicas ao direito ambiental. Em primeiro lugar, reconstrói a ligação entre os três elementos e identifica as principais críticas ecológicas à democracia ambiental. Em seguida, considera os dois modelos de participação ambiental – “optativa” e “prescritiva” – oferecidos pela comparação, no contexto da tripla emergência contemporânea (ecossistêmica, climática e fóssil), diferentes das já conhecidas emergências ambientais. Por fim, considera a estratégia contenciosa e as práticas de eco-democracia como reações a essas emergências, na identificação contextual do “mandato climático” como uma nova prescrição deliberativa de “proteção sustentável”.
